Welcome to pleasantsvalleyag.org, the website of the Pleasants Valley Agricultural Association ("PVAA," "we," "us," or "our"). These Terms & Conditions ("Terms") apply to your use of this website, to purchases made through our shop, and to donations, memberships, and event participation arranged through the site. By using the website, or by completing a purchase, donation, or membership, you agree to these Terms. If you do not agree, please do not use the website.
1. About PVAA
PVAA is a nonprofit association of farmers in Pleasants Valley, Vacaville, in Solano County, California. PVAA is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code (EIN 92-2122248). You can reach us at pleasantsvalleyaa@gmail.com.
2. Using This Website
You may use this website for personal, non-commercial purposes. You agree not to misuse the site, including by attempting to access it without authorization, interfering with how it works, submitting false information or spam through its forms, or copying its content for commercial use.
We work to keep farm listings, event dates, hours, and resource links current, but details change, especially on working farms. Please confirm information directly with the farm or event organizer before you visit. The website provides general information only and is not legal, financial, tax, or agricultural advice. Our resource pages point to outside agencies and programs; always confirm eligibility, deadlines, and requirements with those agencies directly.
3. Farm Directory and Member Listings
Farm and business listings describe independent operations. Each farm or business is responsible for its own products, prices, hours, practices, permits, and conduct. A listing on our website is not an endorsement or guarantee by PVAA. Listed farms may request corrections or removal by emailing us.
4. Shop and Purchases
Who you are buying from. Our shop offers PVAA products as well as products from participating member farms. PVAA products are sold by PVAA. Member farm products are produced and supplied by the farm, and PVAA provides the online shop and processes the order on the farm's behalf. [Each product listing names the farm that produced it.]
Prices and availability. Prices are listed in U.S. dollars. Many products are seasonal and available in limited quantities. We may limit quantities, correct pricing or listing errors, and cancel an order if a product is unavailable. If we cancel an order you have already paid for, we will refund you in full.
Payment. Payments are processed by third-party payment providers. PVAA does not store full credit or debit card numbers.
Taxes. Applicable sales tax is calculated and added at checkout.
Pickup and delivery. Pickup and delivery options for each product, including any locations, times, and fees, are listed on that product's page. Please review them before placing your order.
Returns and refunds. Return and refund requests are reviewed on a case-by-case basis. If there is a problem with your order, contact us with your order number and a description of the issue, and we will work with you to resolve it.
Product information. Farm products are grown and made in small batches, so size, color, and flavor may vary. Some products may contain, or be made alongside, common allergens. Ingredient information comes from the producing farm; if you have an allergy or dietary concern, contact us before purchasing. Please follow any storage or handling instructions provided with your order.
5. Donations
Processing. Donations are voluntary gifts that support PVAA's mission. They are processed through Zeffy, a third-party fundraising platform, and are also subject to Zeffy's terms and privacy policy. Zeffy may invite you to add an optional contribution to Zeffy itself; that contribution goes to Zeffy, not to PVAA.
Tax deductibility. PVAA is a 501(c)(3) nonprofit organization (EIN 92-2122248), and donations are tax-deductible to the extent allowed by law. You will receive an emailed receipt for your records. Please consult your tax advisor about your situation.
Refunds. Donation refund requests, such as for a duplicate gift or a wrong amount, are reviewed on a case-by-case basis. Contact us as soon as possible and we will work with you and Zeffy on your request.
Use of funds. Unless we have agreed with you in writing to restrict a gift, PVAA directs donations to its mission and programs at its discretion.
6. Memberships
Levels. PVAA offers Community Member (non-voting), Land Steward Member (voting), and Harvest Partner (business, non-voting) memberships, as described on our Become a Member page. Membership benefits may change from time to time.
Term and renewal. Memberships last [one year from the date of payment / the calendar year].
Memberships do not renew automatically. To continue your membership, renew through our Become a Member page.
Voting. Voting rights are defined by PVAA's bylaws. Land Steward Members may vote as provided in the bylaws.
Transfers and refunds. A membership belongs to the person or business named on it and cannot be transferred. Membership refund requests are reviewed on a case-by-case basis.
Because PVAA is a 501(c)(3) nonprofit, part or all of your membership payment may be tax-deductible; please consult your tax advisor.
Membership standards. PVAA may decline or end a membership as provided in its bylaws, including for conduct that conflicts with PVAA's mission.
Harvest Partner recognition. Harvest Partners give PVAA permission to display their business name and logo on PVAA's website, social media, and event materials for recognition purposes, and confirm that they have the right to grant that permission. PVAA may decline to display content it considers inappropriate.
7. Events and Farm Visits
Working farms. PVAA events, including Open Farm Day, take place on working farms with uneven ground, livestock, machinery, bees, water, dust, and changing weather. You attend at your own risk. Wear closed-toe shoes, stay in areas open to visitors, and follow all instructions from farm staff and volunteers and any posted rules.
Children and animals. Children must be supervised by an adult at all times. Touch or feed animals only where the host farm allows it, and wash your hands after any contact with animals.
Activities. Some activities, such as hayrides and riding demonstrations, may have separate rules, age limits, or waivers set by the host farm. Participation is voluntary.
Pets. [Please leave pets at home unless the host farm states otherwise. Service animals are welcome.]
Changes and cancellations. Events may be changed or canceled because of weather, fire danger, or other circumstances. We will post updates on our website and social media. Any refunds for ticketed events follow the policy stated at the time of purchase.
Photography. PVAA and its partners may photograph or film events and use those images to promote PVAA and its farms. If you prefer not to be photographed, please let a photographer or volunteer know.
Conduct. PVAA and host farms may refuse entry to, or ask to leave, anyone whose behavior is unsafe or disruptive.
Host farms. Host farms are independently owned and operated. To the extent permitted by law, PVAA is not responsible for host farms' premises, products, or activities.
8. Newsletter, Forms, and Surveys
By signing up for our newsletter, you agree to receive email updates from PVAA. You can unsubscribe at any time by replying to any of our emails or by writing to pleasantsvalleyaa@gmail.com. Information you submit through our website forms is delivered to us through third-party services. Visitor surveys may be hosted by our partners, such as UC Agriculture and Natural Resources, and are subject to their policies.
9. Third-Party Links and Services
Our website uses and links to services and sites we do not control, including GoDaddy, Zeffy, FormSubmit, Qualtrics, Instagram, Facebook, and government and nonprofit resource sites. PVAA is not responsible for their content, availability, or privacy practices. Your use of those services is governed by their own terms.
10. Intellectual Property
The text, photos, logo, and graphics on this website belong to PVAA or are used with permission. You may share links to our pages, but you may not copy or reuse our content for commercial purposes without our written permission. Farm names, logos, and photos belong to their respective owners.
11. Privacy
We collect the information you choose to give us, such as your name, email address, messages, and order, membership, or donation details. Payments are handled by our payment providers. Our website host may also collect basic, non-identifying usage data. We use this information to fulfill orders, process memberships and donations, respond to you, and send updates you have requested. 12. Disclaimers
The website and its content are provided "as is" and "as available." To the fullest extent permitted by law, PVAA makes no warranties of any kind about the website, including warranties of accuracy, availability, or fitness for a particular purpose.
13. Limitation of Liability
To the fullest extent permitted by law, PVAA and its board, members, volunteers, and host farms will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website, purchases, donations, memberships, or event participation. For any claim related to a purchase, PVAA's total liability will not exceed the amount you paid for that purchase. Nothing in these Terms limits any liability that cannot be limited under California law.
14. Indemnification
You agree to indemnify and hold harmless PVAA and its board, members, and volunteers from claims arising from your misuse of the website or your violation of these Terms.
15. Governing Law
These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Solano County, California. Before taking formal action, we encourage you to contact us so we can try to resolve the issue informally.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the new version on this page and update the effective date. Your continued use of the website after an update means you accept the revised Terms.
